Aliens Police

Aliens Police is the name of the immigration authorities in Switzerland and Austria .

Austria

It is based at the district authorities and federal police departments and regulates all matters of aliens police law. A distinction must be made with matters relating to the right of establishment. Settlement authorities are the district authorities and - in cities with their own statute - the magistrates .

In Vienna , the tasks of the settlement authority are assigned to Municipal Department  35 (MA 35); Aliens police matters in Vienna are handled by the Aliens Police Office of the Vienna State Police Directorate.

Main difference between the Aliens Police Law and the Right of Establishment

The Austrian Aliens Police Act 2005 (FPG) regulates the procedure of the Aliens Police regarding the issuing of entry permits, rejection, the issuing of measures to terminate residence, deportation, tolerance, the enforcement of return decisions from EEA states and the issuing of documents for aliens. The Settlement and Residence Act (NAG), on the other hand, regulates the various residence permits and their issuing requirements for stays of generally more than six months. For shorter stays, with a few exceptions, European Union law applies, which is codified in Regulation (EU) 2018/1806 (EU Visa Regulation) and Regulation (EC) No. 810/2009 (Visa Code ) .

As part of the security administration, the Aliens Police work closely with other authorities on various issues. In some cases, other authorities are obliged to notify the Aliens Police of certain incidents in which strangers are involved (e.g. in the case of criminal convictions).

Switzerland

As a communal or cantonal authority, the Aliens Police are responsible for enforcing federal law on aliens. She is responsible for entry and residence permits , asylum seekers and deportations . In most of the cantons , the former Aliens Police were renamed the Migration Office .
