The Gas Network Fee Ordinance ( GasNEV ), a German ordinance on fees for access to gas supply networks , regulates the determination of the network usage fees for the transmission of gas through the networks of the gas network operators to the consumers in the liberalized energy market. It became necessary in the course of the reformulation of the Energy Industry Act and has replaced the regulations of the association agreement on network usage charges originally set at a non-state level with a state specification. In addition to the actual regulations for determining the network charges that can be approved, the GasNEV includes regulations for unbundling and stipulates various reporting obligations.

The GasNEV came into force on July 29, 2005. The provisions of this ordinance are supplemented by the Incentive Regulation Ordinance (ARegV), which has implemented the incentive regulation applicable since January 1, 2009 .

Regulatory priorities of the GasNEV

The ordinance specifies the methods of setting network charges, for which gas supply network operators are allowed to charge transport customers charges for access to their networks. It creates the basis for the regulatory authority's activities in this area and regulates the network operators' publication obligations. It applies to all gas supply networks in Germany and takes into account the structural and gas-related features of the German gas market.

Method of determining network charges

In Part 2 of the ordinance, the method for determining network charges is defined in Sections 4 ff . This includes cost type, cost accounting and cost unit accounting. There is a special fee regulation for the transport of biogas ( § 20b GasNEV).

According to § 30 GasNEV, the regulatory authority ( Federal Network Agency ) has extensive rights to make stipulations for the determination of costs and charges in order to achieve efficient network access. It has made use of this several times in the past. According to Section 29 GasNEV, the regulatory authority can make decisions on the scope, time and form of the information to be transmitted to it, in particular on the permissible data carriers and transmission routes, to simplify the procedure by stipulating in accordance with Section 29 (1) of the Energy Industry Act.

Publication requirements

Section 27 (1) of the GasNEV obliges gas network operators to publish the network charges applicable to their network on their websites and to notify them immediately in text form upon request. If individual network charges are created in accordance with Section 20 , these must be included in the publication of the network charges and reported to the regulatory authority immediately.

According to Section 27 (2) of the GasNEV, gas network operators are obliged to regularly publish the following updated information on structural features on their websites on April 1 of each year:

  • Length of the gas pipeline network, each separately for the low pressure, medium pressure and high pressure level as of December 31 of the previous year.
  • Length of the gas pipeline network in the high pressure level according to pipe diameter classes.
  • Annual work taken in the previous year by distributors and end consumers in kWh.
  • Number of exit points for all pressure levels (definition according to the measurement pressure on the meter).
  • Simultaneous annual peak load of all withdrawals in kWh per hour and the time of the respective occurrence (date / time).
