Energy law (Germany)

The Energy Law is the set of legal norms that the energy control. In a narrower sense, energy law is understood to mean the law of grid-based energy supply with electricity and gas, the relevant provisions of which are contained in the Energy Industry Act (EnWG). For some years now, the density of regulations in energy law has increased considerably and energy law has become more multi-layered and complex.

General

Energy law is a complex legal matter consisting of norms of public law and private law. Due to the effects of energy generation, energy distribution and energy consumption on nature and the environment, it is increasingly related to environmental law.

In addition to the Energy Industry Act, there are a large number of laws and ordinances that form the legal framework for the energy supply market. The environmental energy law on the one hand and the regulations on network expansion on the other hand are of increasing importance. For many years now, the influence of European law on the design of energy law has also increased.

The goals of energy (economic) law are the most secure, inexpensive, consumer-friendly , efficient and environmentally friendly energy supply for the general public, ensuring effective and undistorted competition in the supply of energy and ensuring long-term, efficient and reliable operation of the energy supply; The aim of national energy law is also the implementation and enforcement of the energy law of the European Union (see § 1 EnWG).

Sub-areas

Energy law is divided into energy industry law, energy cartel law, energy consumer protection law, energy environmental law and energy security law.

There are also other areas of law that provide special regulations for the energy sector, e.g. B. the energy tax law .

The most dynamic development at the moment is energy environmental law, which has the promotion of renewable energies , emissions trading and increasing energy efficiency as its object. This is a sub-area of ​​environmental energy law, which, in addition to the area of ​​line-based energy supply, also includes the areas of heat supply and mobility; important laws are u. a. the Combined Heat and Power Act , the Renewable Energy Sources Act and the Act on Energy Services and Other Energy Efficiency Measures .

Teaching and Research

The most important research institutions in the field of energy law are the Institute for Energy Law at the University of Cologne , the Institute for Mining and Energy Law at the Ruhr University Bochum , the Institute for German and international mining and energy law at the TU Clausthal , and the Institute for Energy Law at Friedrich -Schiller University Jena , the Institute for Energy and Regulatory Law Berlin e.
