The General Public Prosecutor's Office is the superior authority of the public prosecutor's office in Germany and some other countries .

The General Public Prosecutor's Office (GStA) in Germany is the public prosecutor's office formed by a higher regional court ; it is an authority of the respective federal state . It is not to be confused with the Attorney General at the Federal Court of Justice .

The jurisdiction of the Attorney General at own investigation extends to state security offenses , such as construction , peace and treason and crimes against the external security.

Furthermore, the Attorney General's Office decides through decision on complaints against orders of the public prosecutor.

Furthermore, the GStA affects any of these decisions on revisions to criminal convictions of official and district courts as well as on legal complaints against decisions imposing fines to the local courts.

The head of the authority is the Attorney General , who according to § 147 No. 3 i. V. m. 146 GVG exercises the specialist and official supervision of the public prosecutor's offices in his district and is in turn bound by instructions from the responsible state ministry of justice . According to § 152 Abs. 1 GVG he is authorized to give instructions to all police officers in the investigation service in criminal matters.

Other German-speaking countries

In Switzerland , the organization of the public prosecutor's office is the responsibility of the cantons. There is an attorney general, for example. B. in the canton of Geneva . In Switzerland, the public prosecutor's office is responsible for the public security department .

In Austria , a senior public prosecutor's office has been set up at each of the four higher regional courts. The Austrian General Prokuratur , on the other hand, represents the interests of the state in the administration of justice, in particular at the Supreme Court .
