The Act on Costs of Voluntary Jurisdiction for Courts and Notaries ( Court and Notarial Fees Act ) came into force on August 1, 2013 and replaced the previous cost structure for voluntary jurisdiction proceedings .

The rules applicable to the courts and notaries have been clearly separated from one another. All regulations that only concern notaries have been summarized in a separate chapter. Fees that affect notaries have been summarized in a separate part of the schedule of costs.

Compared to the previous KostO, there is a separate cost directory in Appendix 1 of the new GNotKG with five-digit cost directory numbers for court and notary fees and expenses. Most of the goals of the amendment of the law of modernization, more performance-based structuring of fees and simplification were achieved.

The large distributed over the entire costs order value measures have been concentrated and evaluation - and business value divided regulations. While all valuation regulations apply equally to courts and notaries, the business value regulations were regulated separately according to the different tasks for courts and notaries.

The GNotKG provides for two different fee tables in § 34 (Table A and Table B), whereby the fees of the notaries as well as the court in inheritance matters and in land register matters are calculated according to Table B. In all other matters of voluntary jurisdiction with regard to court costs, table A applies. Tables A and B can be found for amounts in dispute of up to 3 million euros in Appendix 2 to § 34 GNotKG .
