The Act for the Protection of Cultural and Natural Assets ( Turkish Kültür ve Tabiat Varlıklarını Koruma Kanunu , abbreviated KTVKK ) of July 21, 1983 is the Turkish Monument Protection Act . Colloquially it is also called the Turkish antiquities or antiquities law .

The KTVKK defines the movable and immovable cultural and natural assets to be protected , regulates the measures to be taken for their protection and determines the establishment and competencies of the competent authorities (Art. 1).

It came into force in accordance with Art. 77 KTVKK with publication in the Official Gazette of Turkey on July 23, 1983. At the same time, Art. 76 KTVKK entered into force the antiquities law (Turkish Eski Eserler Kanunu , abbreviated EEK) No. 1710 of April 25th 1973 expired. The KTVKK has since been changed several times.

Export ban

Violations of the export ban for cultural and natural goods (Art. 32 KTVKK) are punishable by imprisonment ( hapis cezası ) of five to twelve years and a fine ( adlî para cezası ) of up to 5,000 daily rates in accordance with Art. 68 KTVKK . The latter is an exception to Art. 52 tStGB .

The law regulates the return of illegally exported cultural goods.

In practice, the law not only sanctions robbery excavations , but also prosecutes cases in which tourists want to take protected cultural assets with them as souvenirs . Between 1998 and 2002, 15 German citizens were arrested for violating the law; two defendants were sentenced to prison terms and one to a fine.
