Legal cohabitation

The legal cohabitation is in Belgium a legally recognized partnership.

The law introducing legal cohabitation of November 23, 1998 was published on March 2, 2000 in the Belgian State Gazette. In addition to the factual coexistence without legal effects under civil law and marriage , it is the third form of cohabitation in Belgium for both same-sex and opposite-sex partners.

Legal cohabitation is justified by a joint declaration by two adults before the municipal authority. The declaration is entered in the population register (residents' registration register). The people live in separate property . In the event of inheritance since May 18, 2007, the surviving person is legally entitled to usufruct of the property and household goods they live in, but this can be waived by will .

The legal cohabitation can be ended immediately by mutual consent and after three months by a formally delivered unilateral declaration. It also ends with the death or marriage of a partner.
