The Grain and Feed Trade Association ( GAFTA ) is an international association of grain and feed traders. According to the company, around 1000 members are represented in 90 countries. The GAFTA goes back to the London Corn Trade Association (LCTA) founded in 1878, which merged with the London Cattle Food Association (LCFA) in 1971 and formed the GAFTA after it had split off from the LCTA in 1906. GAFTA operates from four offices in London (headquarters), Beijing , Geneva and Kiev .
The aim is to promote international trade and protect member interests. The activities of GAFTA include setting trading conditions and arbitration in the event of disagreement.
GAFTA contracts
GAFTA issues more than 80 different contracts . These are grouped by type of goods, destination and delivery conditions. A distinction is made in particular between CIF and FOB contracts. In addition, a distinction is made between whether the seller only has to deliver the goods as they arise ( Tel-Quel clause ) or whether the seller guarantees the condition of the goods upon arrival ( rye terms ).
The GAFTA contracts are mainly used when agricultural raw materials such as grain and animal feed are traded worldwide. While the standard conditions in the German grain trade and contract slip conditions play a role in Germany inland and in the near border traffic , the GAFTA contracts are tailored to overseas trade.
The contract works are in accordance with extraordinary detail of the English treaty practice and set the following points of a trading business fixed
- Quality, conditions, guarantees and warranty obligations
- Shipping documents and delivery obligations
- Risk bearing
- Group shipments
- Supply chains
- Requirements for the ocean-going ship for transport
- Export and import permits
- Insolvency of a contractual partner
- Payment terms
- Problems and Extraordinary Circumstances
- Replacement of demurrage
- Non-compliance and compensation
- Ancillary rules on weighing, sampling, analysis methods and insurance.
Without exception, the contracts contain a choice of law in favor of English law and an arbitration clause in favor of an English court of arbitration . The interpretation of the contracts is therefore subject to English law. At the same time, the GAFTA explicitly excludes other legal norms such as the UN sales law .
