Border permit

A border permit is a personal permit issued by the German Federal Police upon application to cross the Schengen external borders of the Federal Republic of Germany "outside the approved border crossing points , outside the established traffic hours [the" opening times "of a border crossing] or with other than the permitted modes of transport" ( Section 61 (3 ) of the Federal Police Act ).

Without special permission, crossing the border outside of the approved border crossing points or the established traffic hours according to Section 3 and Section 25 (3) No. 2 Passport Act (for German citizens ) or Section 13 (1) and Section 98 (3) No. 2 Residence Act ( for foreigners ) constitutes an administrative offense.

The basis for issuing a border permit is Section 61 (3) of the Federal Police Act . The prerequisite is the existence of a "special need [for this type of border crossing]", the issue is currently free of charge for the applicant.

The border permit is used in practice, for example, by water sports enthusiasts who want to use a port that is not approved as a border crossing point for their landing in Germany or their departure .
