ICP license
ICP license ( English abbreviation for "Internet Content Provider"; Chinese name "ICP 许可证") denotes the official permission to operate a website in China. ICP licenses can usually be found at the bottom of websites.
history
On September 25, 2000, the State Council of the People's Republic of China published the Telecommunications Ordinance and the Ordinance on the Providing of Internet Services (Internet Service Ordinance for short). The telecommunications regulation requires that operators of Internet sites in China must acquire a license. The Internet Service Ordinance obliges Internet service providers to block access to Internet sites without a license. A branch in China is required to acquire an ICP license . ICP licenses are issued by the Ministry of Industry and IT (MIIT) at the provincial level .
Commercial and non-commercial licenses
The MIIT issues two types of ICP licenses:
- ICP registration: ICP registration is usually sufficient for purely informative websites. The majority of all websites fall under this category. An ICP registration is also sufficient for companies that only advertise their own products and services on their website. The company concerned would only have to apply for an ICP license when sales are generated through the use of functions on a website.
- ICP license: If sales are generated through internet services in China, an ICP license is required. This applies to streaming services and search engines with advertising functions ( QQ Music , Baidu ), social media with payment functions ( WeChat ), car sharing services ( Didi ) as well as to cloud services and online retailers ( Alibaba ). The ICP license is an extension of the ICP registration for permission to operate such commercial Internet services in China. Accordingly, an ICP registration must first be carried out before applying for the ICP license.
