Jany decision

The Jany decision is a judgment of the European Court of Justice (ECJ of 20 November 2001 - Case C-268/99 Jany and Others,... NVwZ 2002, 326), according to the prostitution European law under the self- imposed economic activities may fall. The court recognized prostitution as a self-employed activity in accordance with Article 43 of the EC Treaty , 44 of the Europe Agreement EC / Poland, 45 of the Europe Agreement of the EC / Czech Republic and regarded prostitution as part of the community's economic life in accordance with Article 2 of the EC Treaty. The contracting states can replace the question of immorality with their own judgment.
