Johann Fuchs (lawyer)

Johann Fuchs (born September 29, 1946 in Dingolfing ) is a German lawyer and former judge at the Federal Court of Justice .

Life

His first judicial position was in Bavaria in 1974 as a trial reporter at the Landshut district court . From 1976 to 1978 he was seconded to the Federal Ministry of Justice and then worked for a year at the Landshut public prosecutor's office. In 1979 he was appointed judge at the regional court at the Landshut regional court. In 1988 he was appointed judge at the Munich Higher Regional Court , and in 1992 he was appointed presiding judge at the Higher Regional Court. From 1999 to 2001 he was a judge at the Bavarian Supreme Court . On May 2, 2001 he was appointed judge at the Federal Court of Justice, and the XII. Assigned to Senate . On March 1, 2010, Fuchs retired.

Johann Fuchs wrote key decisions of the highest court rulings on the interpretation of the Law of Obligations Adjustment Act and the Usage Fee Ordinance , as well as on the compensation that the property owner has to pay the user for a building ( Datsche ) built by the user after the usage relationship has expired , and on the adjustment of the low usage fees for properties in the former GDR to the current market rent.
