Kahnawake Gaming Commission

The Kahnawake Gaming Commission (KGC) is a regulatory administrative unit in Québec that is responsible for the regulation and licensing of many online casinos, online poker games and online sports betting offices . The commission also licenses three poker casinos in the Mohawk area of Kahnawake .

The founding of the commission was made possible by the Kahnawake Gaming Law of 1996, enacted by the Kahnawake Mohawk Council. However, the Commission's regulatory provisions on interactive gaming did not enter into force until July 1999.

The online gambling licenses issued by the Commission are called "Client Provider Authorization". To obtain such a license, an initial processing fee of USD 30,000 or more is charged, as well as a further USD 5,000 for the licensing of each key person. However, these fees already include the first annual fee and will be reimbursed if the license is not granted. Renewals are offered from $ 10,000.

Both the Kahnawake Gaming Commission and the Mohawk Council of Kahnawake agree that the jurisdiction of the Kahnawake Gaming Law is an aspect of "innate law" that is constitutionally recognized by Canada. The authorities in Canada classify the licenses issued and the games of chance held as illegal, but since the enactment in 1996, neither the law itself nor an issued license has ever been prosecuted.

Although the operators of online casinos are licensed and regulated by the Commission, legislation in many countries is not taken into account. In the USA, since the "Unlawful Internet Gambling Enforcement Act" (UIGEA), which came into force in 2006, efforts have been made to regulate the regulation of online gambling in individual states. Other countries, such as Belgium, Australia and, ironically, Canada, allow online gambling under very strict regulations or not at all.

Regulatory activities

As of June 2019, the Kahnawake Gaming Commission is licensing 20 operators of 97 platforms for online gaming.

In September 2009, after a lengthy investigation, the commission published a decision in which it found that the operator of "Ultimate Bet Poker" had cheated. The operators (Tokwiro Enterprises) were subject to a number of sanctions. Among other things, the stakes of the players (about 22 million US dollars) had to be repaid, a fine of 1.5 million US dollars had to be paid and guidelines for specific changes to the operations had to be implemented in order to rule out further fraud.

At the end of May 2019 it was announced that the Kahnawake Gaming Commission had awarded the world's first "Pure Skill Real Money Gaming License". Players have the opportunity to win real cash prizes based solely on their ability to play a game without a predetermined outcome.
