Competency Conflict Court (Turkey)

The jurisdiction conflict court ( Turkish : Uyuşmazlık Mahkemesi ) is one of the highest courts in Turkey .

Nuri Necipoğlu has been President of the Court since 2016 .

General

The court was founded in 1945 and is the first and last instance to rule on disputes over jurisdiction between the ordinary courts, administrative courts and military courts .

It can overturn the judgments of the Court of Cassation , the Council of State , the Military Court of Cassation and the High Military Administrative Court and is therefore the only judicial body that can overturn final judgments.

The court consists of a president, a vice-president, twelve full and twelve substitute members, and it consists of a civil and a criminal division. The President and the Vice-President are elected from among the members of the Constitutional Court. The origin of the Senate members can be found in the table below.

The General Prosecutors of the Republic at the Court of Cassation, the State Council, the Military Court of Cassation and the High Military Administrative Court, as well as the public prosecutors commissioned by them, can express their opinions in writing as well as orally and are in this context public prosecutors of the conflict of jurisdiction court.
