War Victims Welfare

The war victims is part of the services after the Federal Supply Act be granted in accordance with §§ 25-27j BVG and regulation for war victims (KFürsV).

Beneficiaries

: § 1
: (1) Anyone who has suffered damage to health through a military or military-like service or through an accident while performing military or military-like service or through the conditions peculiar to this service, receives on application because of the health and economic consequences of the damage Care.
: (2) Damage within the meaning of paragraph 1 is equivalent to damage that has been caused by

a) direct war impact,
b) a prisoner of war,
c) internment abroad or in the German territories not under German administration because of German citizenship or German ethnicity,
d) a punitive or coercive measure associated with military or military-like service or with the general signs of disintegration if, under the circumstances, it is to be regarded as an obvious injustice,
e) an accident suffered by the injured party on a way there or back, which is necessary to carry out a measure of curative treatment, a spa cure, handicapped body exercises as group treatment or services for participation in working life according to § 26 or at the request of a competent service provider or to appear in person at a court because of the damage,
f) an accident suffered by the injured party while performing one of the measures listed under letter e.

(5) If the injured person has died as a result of the damage, his surviving dependents will receive care upon request. Paragraph 3 applies accordingly.

In 1997, the law was expanded to include Section 1a, which stipulates reasons for exclusion:

§ 1a
(1) Benefits are to be denied if the person entitled or the person from whom the entitlement is derived has violated the principles of humanity or the rule of law during the rule of National Socialism and he has applied for benefits after November 13, 1997. Indications that require a particularly intensive check as to whether an authorized person has violated the principles of humanity or the rule of law through his or her individual behavior can arise in particular from a voluntary membership of the authorized person in the SS.

War Victims Welfare

Welfare for victims of war includes those entitled according to the Federal Supply Act

  • Help for vocational rehabilitation (§§ 26 and 26a)
  • Sick assistance (§ 26b)
  • Help with care (§ 26c)
  • Help to keep the household going (§ 26d)
  • Elderly assistance (§ 26e)
  • Educational assistance (§ 27)
  • Supplementary support for living expenses (Section 27a)
  • Recreational assistance (§ 27b)
  • Housing assistance (§ 27c)
  • Help in special situations (§ 27d)

Special welfare

Those who are particularly severely affected receive special care (Section 27e BVG).

Responsibilities

Unlike the rest of the services of the Federal Pension Act is war victims not by the supply authorities granted but usually by the independent cities and counties, and - depending on performance - the supra-local support of war victims (in Bavaria, the district administrations or in Hesse of Landeswohlfahrtsverband).

The special welfare is granted by the main welfare offices .
