The Parents 'Council of day care centers in NRW ( LEB ) is a body which representatives of the Youth Welfare Office parents' associations ( JAEBs of) at the country level in accordance with § 9 Children Education Act of the State of North Rhine-Westphalia can be selected in force since 1 August 2011, amended. Since the 2011/2012 daycare year, there have been elections at the state level in North Rhine-Westphalia.

Legal framework

The child education law of the state of North Rhine-Westphalia provides for the first time an elected parent representation at city and state level. Up until now, the election of parent representatives was only provided for at kindergarten level.

Section 9 of the Act regulates the framework conditions. The law provides that the parents' councils in the day-care centers are to be elected by October 10 of each year. In a period from October 11th to November 10th of each year, the assembly of parents 'councils can elect the youth welfare office parents' council at city level. Interpretation of law

The gaps in the law and the urgent need for action by the youth welfare offices have led to a short-term interpretation of the law by representatives of the North Rhine-Westphalia City Council . It is u. a. clarified that parents ' participation does not mean parents' participation . However, the interpretations of the law in the so-called work aid are controversial.

Criticism of the law

The Child Education Act introduces a right to vote in Section 9, which is regulated by a 15% quorum , a tight schedule and a multi-stage election process. This is unique in the area of ​​volunteering and has already been sharply criticized by parents' representatives.

The State Parents' Council represents the interests of around 500,000 children and their parents in North Rhine-Westphalia. “The youth welfare parental councils can join together at the state level in the assembly of the youth welfare parental councils. The Youth Welfare Parents 'Council elects the State Parents' Council from among its members by November 30th of each year.
