Identification of a military area

Military areas in Germany include all installations, facilities and ships of the Bundeswehr and allied armed forces ( Section 2 (1) UZwGBw ), e.g. B. barracks , location and military training areas , warships and army hospitals . Most military areas are also military security areas. Stopping and checking persons ( Section 4 UZwGBw) and ordering searches ( Section 8 UZwGBw) are not permitted in military areas that are not also military security areas. Offenses against a military area or objects of the Bundeswehr are offenses against the Bundeswehr within the meaning of Section 3 (1) No. 2 UZwGBw.

Labelling

Military areas are often marked, even if, in contrast to military security areas ( Section 2 Paragraph 2 Sentence 3 UZwGBw), this is not required by law. They are identified by the designation military area , whereas military areas, which are also military security areas, are identified as military security areas; d. H. an object marked as a military area is not a military security area.

Enter and stay

Unauthorized entry into military areas is prohibited. However, entry into military areas that are not military security areas is often permitted or tolerated for the general public. This can affect, for example, Bundeswehr hospitals , universities of the Bundeswehr and on- site training areas outside of training times. The permit can be revoked at any time, for example if a higher alert level comes into force.

An administrative offense is committed by anyone who intentionally or negligently enters a military facility or facility or a location that is blocked for security reasons in order to carry out official duties of the Bundeswehr, contrary to a prohibition by the competent service. The administrative offense can be punished with a fine . ( Section 114 OWiG ). This regulation is particularly important for military installations that are not pacified, i.e. surrounded by a fence or the like, such as on-site training areas. Anyone who unlawfully intrudes into pacified military facilities, or lingers in them without authorization and does not leave when requested to do so, is not only acting improperly, but commits the offense of trespassing ( Section 123 StGB ). The offense against the application is punished with imprisonment for up to one year or with a fine .
