The Intelligence Service Transmission Ordinance is a statutory ordinance applicable in Germany that contains provisions for the implementation of information procedures in accordance with §§ 8a, 8b of the Federal Constitutional Protection Act and the provisions referring to this in the MAD Act and BND Act . The federal intelligence services can obtain this information in individual cases from aviation companies , computer reservation systems and global distribution systems for flights, credit institutions , financial services institutions and financial companies as well as teleservices in order to clear up violent unconstitutional efforts.
Subject matter
The ordinance contains regulations on the following subjects:
- Carrier media, type of dispatch and encryption of the data to be transmitted;
- Procedure for identifying deficiencies in the data supplied;
- Processing of the request and the application for compensation by the obliged entity;
- Transmission format of the data (basically in XML format);
- Agreement of exceptions between the intelligence service and the obliged entity as well
- Compensation for the effort associated with the information.
