Patent ambush

from Wikipedia, the free encyclopedia

A patent ambush ( English patent ambush ) occurs when a company rights deliberately not disclosing, but waits until the protected technology as a standard is established. This company can then exploit the lock-in effect of the others and usurp the added value.

For this reason, standardization organizations usually require the disclosure of claims in the standardization process.

Examples

  • FTC : Dell case - VESA standard
  • FTC / EK : Rambus case - SDRAM standard
  • EK: ETSI GSM 03.19 case - GSM standard
  • EK: Texas Instruments / Qualcomm case - WCDMA standard
