Presidential Judge

Presidential judges (or judges in the administration ) are professional judges who, in addition to the president of a court, perform judicial administration tasks. In particular, they are responsible for handling matters relating to the Presidium, for certain personnel matters, for making statements to the authorities and the media, and for general legal questions from the court. In the case of higher courts, presidential judges are supported by civil servants.

In some districts of the Higher Regional Court, the presidential judge is only the judge who is the department head responsible for judicial personnel matters. This is regularly the department 1. The presidential judge is mostly responsible for disciplinary proceedings against judges, the appraisal system and the use of judges in their own and, if necessary, subordinate courts.

To the extent that a presidential judge is active in the administration of justice, he is bound by instructions from the president. In so far as he also acts as a judge, he is, like every judge, factually independent .

Demarcation

The judges who belong to the presidium of the court must be distinguished from the presidential judge , i.e. H. the President and the elected members of this body.

A further distinction is to be made between the presidential judges and the judges who are members of the presidential council of the branch in question.

It should also be noted that not every judge in a presidential court is a presidential judge .
