Referendum on changes to family law in Slovenia in 2012

On March 25, 2012, a referendum took place in Slovenia on a law amending the Family Code, which was passed by the government coalition led by Borut Pahor . The law was rejected by voters with 54.55%.

prehistory

The amendment to family law was approved by the government of the former Prime Minister Borut Pahor in parliament on June 16, 2011 with 43 votes to 38 in the last reading. The change in the law provided for a legal expansion of the registered partnerships that had existed since 2006 for same-sex couples, which should have been equated with marriage with the exception of full adoption. In addition, the rights of children would have been expanded with the new regulations, so that corporal punishment of children would have been prohibited in the future. A conservative organization called the “Slovenian Civil Initiative for Family and Children's Rights” led by the activist Aleš Primc (member of the Slovenian People's Party ), with the support of the Catholic Church, collected 80,000 signatures to force a referendum against the change in the law. The government wanted to prevent this and asked the Constitutional Court to clarify whether the referendum would be compatible with the constitution, which decided on December 26, 2011 that the referendum was in accordance with the constitution.

Opinion polls

A poll conducted by the Delo polling institute in February / March showed that 35.9% want to agree to the law, while 26.3% reject it and 20.9% are undecided on this question. The remaining 16.9% of respondents said they would not take part in the referendum. From February 29, 2012 to March 1, 2012, 504 respondents took part in the survey.

In a poll carried out by the Ninamedia polling institute from March 13, 2012 to March 15, 2012, 47.2% of those surveyed were in favor of the law and 40.7% wanted to vote for the law to be repealed, while 12.4% were undecided. The survey was based on responses from 700 people.

Another poll conducted by Delo between March 14, 2012 and March 20, 2012 found that 46.9% of respondents approve the law and 26.9% oppose it, while 16.4% are undecided on this issue. The remaining 7.5% did not want to give an answer. Among those who definitely or probably want to participate in the referendum, the approval rate was 60%, the rejection rate 40%.

Result

The amendment to the law was rejected by a majority of the participating voters. The turnout was a low 30.31%.
