Popular survey on same-sex marriage in Slovenia 2015

On December 20, 2015, a referendum was held in Slovenia on the introduction of same-sex marriage . The law was repealed because a clear majority of voters voted against it and the minimum quorum of 20% no-votes of the entire eligible population was achieved.

prehistory

On March 3, 2015, the parliament of Slovenia approved a law with 51 to 28 votes, according to which marriage should no longer be laid down as a "connection between man and woman" but as a "connection between two people", so the change in the law also worked a full right of adoption for same-sex couples. The House of Lords of Slovenia voted 24-13 against vetoing the law, while conservative opponents of the law, including the Catholic group-backed "Coalition for Children", hopefully collected the 80,000 signatures required to call for a referendum on the law prevent their introduction. On March 26, 2015, the Slovenian National Assembly blocked the referendum by 53 votes to 21, as it believes it violates Article 90 of the Slovenian Constitution, which stipulates that referendums on fundamental and human rights are not permitted. Following the complaint of the initiators of the petition against the law, the Slovenian Constitutional Court declared on October 22, 2015 that the Parliament did not have the competence to decide whether a referendum was valid or not. On November 5, 2015, the Slovenian parliament set December 20, 2015 as the voting date for the referendum with a vote of 60 to 11.

According to Article 90 of the Constitution of the Republic of Slovenia, a law can only be rejected by referendum if a majority of the eligible population votes against it and at least 20% of the eligible population, i.e. at least 343,104 voters (around 20% of the 1.7 million eligible voters ) reject the law.

As early as 2012, a referendum with 54.55% no votes would prevent a law that would have expanded the rights of same-sex partnerships.

The Catholic Church and Pope Francis argued for a "No" in the referendum. A number of EU politicians including Violeta Bulc and all parties in parliament, apart from the SDS and the NSI , pleaded for a "yes" in the referendum.

Opinion polls

A poll by the electoral research institute Delo Stik, carried out in February 2015, found that a majority of 51% of respondents approve of the legislative initiative, while 42% oppose it.

Another survey conducted by Ninamedia in March 2015 found that 42% of those surveyed support the law and 54% oppose it. The highest approval rate was found among people under the age of 30 and residents of the Slovenian coastal region of Primorska .

An opinion poll conducted in November 2015 found that 46% of respondents support the law and 54% oppose it. The survey divided respondents into different groups with clear differences of opinion. A majority of women, atheists and people who lived in cities supported the law in question in the referendum, in contrast to which a clear majority of men, Catholics and the rural population opposed it. It also noted that voter turnout is likely to be low and therefore likely a non-binding result.

Results

The pre-selection began on Tuesday, December 15, 2015. The result was announced on December 20, 2015 after all polling stations were closed. The bill was rejected by a majority of the participating voters and the necessary quorum of 20% was also met. Thus the referendum was constitutionally binding.
