State Council (Slovenia)

The State Council ( Slovene Državni svet ) is the upper house of the Slovenian parliament . Its task is to represent social, economic and regional interests in the Slovenian legislature .

The lower house is called Državni zbor (State Assembly).

The State Council consists of 40 MPs, who are delegated by functional (i.e. social and economic) and regional interest groups.

The members of the Council of State are not determined by universal suffrage. The respective procedure within an interest group that sends MPs applies. The term of office is five years.

The 18 representatives of functional interests are elected by an electoral college, the composition of which is regulated in the interest groups.

For the election of the 22 representatives of regional interests, the national territory is divided into 22 constituencies . The composition of the electoral college in the constituencies is determined by the municipal councils in a secret ballot. If there is more than one ward in the constituency, each ward sends a representative to the electoral college; for every 5,000 inhabitants, the number increases by one additional representative.

A candidate is deemed to have been elected to the Council of State if he can win a relative majority of the votes cast.

All Slovenian citizens who have reached the age of 18 have in principle the right to vote and stand for election in relation to the State Council . This is determined by membership of an interest group (functional and / or regional). If they can be assigned to a functional interest group, non-Slovenian citizens have the right to vote, but not the right to vote.

Powers

According to the Slovenian constitution, the tasks of the State Council include:

  1. Right of initiative in the legislative process
  2. Adoption of opinions to the State Assembly (both by the State Council as a whole and by individual committees)
  3. Suspensive veto right against a law passed by the State Assembly
  4. the right to ask the State Assembly to call a referendum on a proposed law or recently passed law; the State Assembly must comply with this request
  5. the right to ask the State Assembly to set up a committee of inquiry ; the State Assembly must comply with this request
  6. the right to have the constitutional conformity of existing laws checked by the Constitutional Court

The approval quorum for all powers of the State Council (with the exception of point 4) is 50% plus one vote (of the votes cast). Exercising the right to call a referendum (point 4) requires an absolute majority of all MPs (i.e. at least 21 votes). At all votes of the State Council this majority, at least 21 members must be present.
