The Directive 2001/14 / EC of the European Parliament and of the Council of 26 February 2001 on the allocation of infrastructure capacity of the railway and the levying of charges for the use of railway infrastructure and safety certification, being a part of the first railway package to the applicable in the railway sector EU -Law. Together with Directive 91/440 / EEC and Council Directive 95/18 / EC of June 19, 1995 on the granting of licenses to railway undertakings, it represented the first step towards regulating the European rail transport market by opening up the market for cross-border rail freight services opened.

It regulates according to Art. 1 "the principles and procedures for the determination and calculation of infrastructure charges in rail traffic and the allocation of rail infrastructure capacity" for the members of the European Community .

Directive 2001/14 / EC was transferred to Directive 2004/49 / EC ("Railway Safety Directive") in the Second Railway Package and supplemented by joint measures to improve and develop railway safety. The provisions in Article 32 of Directive 2001/14 / EC on the separate safety certificate required for cross-border traffic had proven to be inadequate, and there were still differences between national safety requirements, which impaired the smooth functioning of rail traffic in the Community.

Directive 2004/49 / EC was implemented in Germany not only in the General Railway Act , but also, for example, with the Railway Safety Ordinance (ESiV). Regarding the requirements for safety certificates and safety permits, the Federal Railway Authority according to Section 4 (2) ESiV created guidelines.

With Directive 2008/110 / EC, the Commission has been given the power to revise and adapt the Annexes to Directive 2004/49 / EC, to adopt and revise common safety methods and common safety objectives, and to define a system of maintenance certificates.

The EU Regulation No. 1158/2010 specifies Art. 6 Para. 3 Letter b of Directive 2004/49 / EC defines a common safety method (CSM) for the conformity assessment with regard to the requirements for safety certificates; Regulation (EC) No. 352/2009 contains one for standard-gauge public railways Safety assessment according to the statistics-based system in accordance with Article 6 Paragraph 3 Letter a of Directive 2004/49 / EC.
