The European Equal Pay Directive or Directive 75/117 / EEC is a regulation of the European Community for gender equality within the European Union . Together with Directives 76/207 / EEC , 86/378 / EEC and 97/80 / EC , it was combined in the new Directive 2006/54 / EC of July 5, 2006. The new directive repeals Directive 75/117 / EEC on August 14, 2009.

The directive lays down the principle of equal pay for work of equal value.

Implementation in national law

In Germany, the Equal Pay Directive was implemented through Section 612 (3) BGB. The General Equal Treatment Act (AGG) overruled Section 612 (3) BGB.

criticism

According to criticism from the German Association of Women Lawyers, Section 612 (3) BGB only implements what was already established by Article 141 EC; in particular, Article 1 of Directive 75/117 / EEC has not been implemented in Section 612 (3) of the BGB. After the AGG came into force, the lack of implementation was further exacerbated, since 8 (2) AGG fell short of Section 612 (3) BGB.
