Situation in Bavaria

The project was pursued by the state government and should result in a law by May 2010. On June 1, 2010, an amended version of the Bavarian Education Act came into force, which resulted in innovations in the area of ​​data processing. However, a student ID has not been introduced.

Situation in Berlin

In Berlin, a draft law for the establishment of the “automated student file” was passed on February 19, 2009. In the run-up to the event, the “Freedom instead of Fear” alliance launched the “Alliance against the Student File” and both informed the public and organized the protest.

Through the work of the alliance and manifold criticism z. B. of the State Commissioner for Data Protection , Alexander Dix , the following key points of the previously planned law could be adapted to data protection requirements:

  • There is no provision for central data storage on a senate's own server. The student data is stored on the school's own servers and only queried centrally (Section 64a, Paragraph 5).
  • A student identification number is not provided and is replaced by a technical "classification feature". This technical classification feature may not be transmitted to other bodies (§64a Paragraph 3).
  • Data on the “non-German language of origin”, the “exemption from teaching materials” and “special educational needs” may only be transferred or accessed in an aggregated, non-personalized form.
    The "Alliance against the Student File" continues to criticize the central inquiry point, e.g. B. for the police. In addition, the youth welfare office, youth court assistance, probation assistance, health authorities and others access the automated student file, which is also controversial (Section 64a, Paragraph 2, last sentence).
  • An additional §64b ( evaluation report ) was inserted to check the proportionality of the measures and their success.

At the turn of the school year in 2009, the automated student database was introduced in 96 so-called project schools (8 schools each in 12 school districts). The student file alliance planned information events for parents and students as well as protests, e.g. B. as part of the demonstration “ Freedom instead of fear ”.

The cost of the automated student file was given as around 1 million euros. The technical equipment required for this, however, took place as part of the Berlin program "eGovernment at School", the cost of which was estimated at 23 million euros. Long-term delays in connecting schools to the network also mean that much higher costs can be expected when setting up the student database.

Because of these problems in setting up the IT infrastructure for the data collected locally in the schools, the student file is still not functional at every school in Berlin.

Situation in Hamburg

A central student register was introduced in Hamburg in 2005, which represents “a central data collection with which all school-age and school-age children and young people in Hamburg are recorded”. Even after its introduction, the register has been heavily criticized by the data protection officer there.

Situation in North Rhine-Westphalia

The state government of North Rhine-Westphalia announced in 2006 that it would not consent to the introduction of the identification number for reasons of data protection. The “Student File” project was suspended due to resistance from the state data protection authority.
