State representative for data protection

The state commissioner for data protection (LfD, also state data protection commissioner ) is the data protection commissioner of a German federal state . He monitors and advises the state's public authorities on data protection issues . Within the scope of this task, he is independent, free of instructions and only subject to the law. In most federal states, it is also the competent supervisory authority according to Section 38 (6) BDSG for non-public bodies within the scope of the third section of the Federal Data Protection Act .

The legal status and the powers of the LfD are regulated in the respective state data protection laws.

The state data protection officers of Baden-Württemberg , Berlin , Brandenburg , Bremen , Hamburg , Hesse , Mecklenburg-Western Pomerania , North Rhine-Westphalia , Rhineland-Palatinate , Saarland , Saxony-Anhalt , Schleswig-Holstein and Thuringia are not only responsible for data protection but also for freedom of information or responsible for the right to inspect files .

In addition to Bavaria, the state commissioners for data protection are also responsible for data protection supervision in the non-public area, ie in business enterprises, associations, associations or parties. In Bavaria there is an independent state office for data protection supervision based in Ansbach . In the course of the implementation of a ruling by the European Court of Justice of March 9, 2010, the state data protection officers are no longer subject to any supervision by other state institutions, even in their supervisory activities in the non-public area. In the opinion of the European Court of Justice, the legal supervision of the respective state government that originally existed in many countries did not guarantee the necessary independence of the supervisory authorities.

Together with the Federal Data Protection Commissioner and the President of the Bavarian State Office for Data Protection Supervision , they form the conference of the independent data protection authorities of the federal and state governments .
