The State Commissioner for Data Protection Saxony-Anhalt is an independent authority of the State of Saxony-Anhalt based in Magdeburg . Its task is to monitor compliance with the data protection regulations at the state's public bodies and - since October 1, 2011 as a supervisory authority - also at the non-public bodies based in Saxony-Anhalt. The legal basis for this activity is the law on the protection of personal data of citizens of March 12, 1992.

In addition, the State Commissioner for Data Protection in Saxony-Anhalt has been performing the tasks of the State Commissioner for Freedom of Information since October 1, 2008.

The state data protection officer (LfD) is also the person who exercises the office of the state data protection officer. She is elected for a six-year term. The current LfD of Saxony-Anhalt is Harald von Bose , who succeeded Klaus-Rainer Kalk in 2005 .

Legal bases

The establishment of the state commissioner is constitutionally secured in Article 63 of the constitution of the state of Saxony-Anhalt. He is elected for six years by the state parliament with a two-thirds majority at the suggestion of the state government. After the candidate of the state government failed to find a majority in three ballots in May 2018, a constitutional amendment is being discussed.

The most important additional legal basis is the "Law for the Protection of Personal Data of Citizens" (DSG LSA). The fourth section of this law (§ 20 ff) regulates the tasks, position, rights and competencies of the state data protection officer.

These regulations are specified in the “Administrative Regulations for the Law on the Protection of Personal Data of Citizens” (VV-DSG-LSA).

According to the “Saxony-Anhalt Information Access Act” (IZG LSA), the state commissioner for data protection in Saxony-Anhalt is also designated as the state commissioner for freedom of information.
