Conference of the independent data protection authorities of the federal and state governments
The Conference of the Independent Data Protection Authorities of the Federal Government and the Länder (in short: Data Protection Conference , DSK ) is a body that deals with current issues of data protection in Germany and takes a position on them. The conference consists of the Federal Data Protection Commissioner , the country's data protection officer of the 16 states and the President of the Bavarian State Office for Data Protection Inspectorate .
General
The first conference took place on December 7, 1978 under the Hessian presidency. Originally it was just a regular meeting of government data protection officers. Over the years, however, these meetings acquired a quasi-institutional character, so that today the conference is no longer just an event, but an independent institution. Their composition, tasks, forms of action and their working methods are laid down in rules of procedure.
The cooperation and coordination of the data protection officers forms a counterweight to that of the ministers (e.g. the Conference of Interior Ministers ) that should not be underestimated . Like this, the data protection conference is also divided into various working groups. For example, the working group “Technical and organizational data protection issues” (AK Technik) prepared working material for the conference in connection with the question of the introduction of biometric features in passport documents by meeting at the beginning of 2002 at the Fraunhofer Institute for Computer Graphics Research (IGD) in Darmstadt and discussed the scientific principles there; Towards the end of the year it then met at Bundesdruckerei in Berlin and discussed various identification systems. The Düsseldorfer Kreis , once a joint body of the highest supervisory authorities that monitor compliance with data protection in the non-public area in Germany, was transformed into a working group of the conference called AK Wirtschaft (Düsseldorfer Kreis) based on a resolution of the 95th data protection conference in 2018. converted, its sub-working groups upgraded to independent working groups.
The conference summarizes the results of its work mainly in decisions and resolutions. The resolutions require a 2/3 majority, all other decisions are made by the conference with a simple majority. The joint positions of the conference are not legally binding. However, due to the technical competence and authority of the conference participants, they have factual effects on the development of data protection.
The chairmanship changes annually - usually in alphabetical order of the federal states and the federal government. In 2020, the Saxon data protection officer Schurig will hold the chair.
