Damage insurance
The non-life insurance (also: non-life insurance ) is an insurance contract by which the insurer is obliged to by the insured event occurred pecuniary loss of the policyholder to replace ( § 1 paragraph 1 sentence 1. SGA ).
Damage insurance is aimed at covering damage , with the agreed insurance benefit or the actual amount of damage regularly forming the upper limit of the compensation. The absolute upper limit is the sum insured . Types are liability insurance , fire insurance , hail insurance , animal insurance , transport insurance or luggage insurance . The provisions of Section 74 ff. VVG apply to all of these damage insurance policies.
The counterpart to damage insurance is the sum insurance , in which a fixed sum insured is determined.
The prohibition of enrichment prohibits an unjustified enrichment of the policyholder through the insurance benefit (exceptions: new value insurance , fixed rate and agreed higher performance promise of the insurer).
