Road construction load

As road construction is referred to all the construction , the maintenance and the operation of roads and paths related tasks and duties. The so-called road construction agency is responsible for fulfilling these tasks and obligations . In terms of the legal system, the term road construction load is not related to other construction loads .

The road construction load refers not only to the road or the path as such, but also extends to the associated road equipment , structures (such as bridges , tunnels , noise barriers ) as well as green and wooded areas along the road .

In Germany, the road construction load for federal highways (federal highways and federal highways) is generally the responsibility of the federal government ( Section 5 of the Federal Highways Act ). If the through-roads are federal, state or district roads, the road construction load is transferred to the municipality. This transfer depends on the population of the municipality and differs in the individual federal states. These regulations are set out in the respective road laws of the federal states. In accordance with Art. 90 of the Basic Law, the federal states are responsible for the administration of federal trunk roads (federal contract administration). The federal states are also responsible for the road construction load on state or state roads . The district roads are the responsibility of the districts. For the remaining public roads, the road construction load lies with the municipalities.

The distribution of road construction loads is similar in Austria. According to the Federal Roads Act, the federal government is responsible for the construction and maintenance of motorways and federal highways, and the federal states for state roads. The remaining road network, if it is not in private hands, falls to the municipalities.

Road construction work in Switzerland is incumbent on the cantons; the federal government, as the highest supervisory authority, has the right to rule on the national highways (Art. 83 Federal Constitution ). For roads that are neither assigned to the cantons ( cantonal roads ) nor to the federal government, the road construction load lies with the municipalities.
