The Supreme Court of Kenya is the highest court in Kenya within the political system of the republic .

history

The court was first provided for with the new constitution of Kenya adopted by the constitutional referendum in 2010 . In June 2011, the Judicial Service Commission had nominated five candidates, four men and one woman, from the candidates for the office of judge in the Supreme Court. The candidates were confirmed by President Mwai Kibaki . On August 29, 2011, the first judges of the newly established Kenyan Supreme Court took their oath of office in the presence of the President. The court began its work on October 10, 2011, the first litigation regarding the date of the 2012 elections in Kenya. However, the Supreme Court declined to make a decision.

Jurisdiction

According to Art. 163 Paragraphs 3, 4 and 5 of the Kenyan Constitution, the court has exclusive jurisdiction over disputes relating to the election of the Kenyan President, appeals against decisions of the other highest courts in Kenya, insofar as these concern constitutional questions or if the Court of Appeal or the Supreme Court to determine that it is a question of law of general concern. Furthermore, the court is responsible for cases that are assigned to it by national law. Under Article 163, Paragraph 6 of the Constitution, upon request by the government, any state agency, or any county government, the court may provide legal advice on any matter of county administration.

The procedure is based on the requirements of the constitution, according to Article 163, Paragraph 8, the Supreme Court has its own procedural rules; further requirements can result from a parliamentary act (Article 163, Paragraph 9). In 2011 the Supreme Court Bill was issued.

occupation

The court consists of the Chief Justice of Kenya, who is also President of the court, the Deputy Chief Justice , who is also the Vice-President of the court, and five other judges (Article 163, Paragraph 1 of the Constitution).

President of the court is Willy Mutunga , vice-president is Nancy Baraza , other judges are Philip Tunoi , Jackton Ojwang , Mohammed Ibrahim , Njoki Ndung'u and Smokin Wanjala .
