TR (abbreviation for technical rules; Russian технический регламент ) is a regulation with which the reform of the Russian certification system GOST-R is to be carried out.

In 2003, the Russian Federation responded to the global demands of the economy with the Federal Law on Technical Regulation . The aim was and is to develop technical legislation and technical regulation similar to the European system of harmonization in standardization and legislation , so that standardization under private law and state legislation are in harmony.

Technical regulation reform

Objectives of the reform

The aims of the reform are to remove the obstacles in the form of unfounded administrative barriers to the development of industry (first of all, the excessive state standardization), to remove the restrictions on technical progress and further development (due to the mandatory requirements of the standards), the development of the entrepreneurial initiative, including the active involvement of manufacturers in standardization processes, as well as the development of technical regulations (general and specific) in each sector. Depending on the area of ​​application of the products, they contain a composition and the requirements to meet:

  • Fire safety
  • industrial security
  • chemical safety
  • electrical safety
  • Radiation safety
  • biological security
  • Ex security
  • mechanical security
  • thermal safety
  • nuclear and radiological security
  • EMC safety for devices and systems
  • Unit of measurements.

After the TR came into force, the application of national standards (GOST) is voluntary for most product groups. The content of the technical regulations are safety requirements for products and manufacturing processes.

TR aims to ensure:

  • Security for the life and health of citizens
  • Security for the assets of private and legal persons as well as state assets
  • environmental Protection
  • Protection of flora and fauna
  • Preventing actions that could mislead consumers.

Legal requirements

TR enter into force six months after their official publication at the earliest (different periods are provided depending on the industry: 6 months, one year, 2 years). Only the product requirements stipulated in the TR are mandatory. In the transition phase , “old” state standards (GOSTs) remain binding. Technical regulations passed by the Duma , 18 TRs, as of May 1, 2010 are among others. a .:

  • TR on the safety of machines and systems (replaced by TR ZU from February 15, 2013)

Transition process from GOST-R certification to TR certification

Existing GOST-R certificates remain valid. In the case of series certificates, the standard authority recommends that the GOST-R certificate be converted into a TR certificate when the TR- certificate comes into force; the term remains unchanged. In the case of contract-related deliveries, the time of delivery and placing on the market is decisive. The current legal requirement applies here. It is important to coordinate with the customer and the certification partner before delivery.

Technical regulation, current changes

Since February 2010, the new list of products that are subject to certification and declaration has been in effect for the GOST-regulated area . With Federal Law No. 385 of December 30, 2009 on Amendments to the Federal Law on Technical Regulation , at the personal request of Russian President Dmitry Medvedev, the original deadline of 2010 was repealed and the following points were ordered:

  • Simplification of the procedure for TR introduction or amendment in Russia (Ministry of Industry and Trade)
  • Use of international or foreign standards and guidelines is permitted (official translation, expertise by the standard authority, registration in the state standard information depot)
  • Elaboration of further TRs with no time limit.

Technical regulations of the Single Customs Union

The Russian Federation, Belarus and Kazakhstan decided in June 2010 to introduce a uniform system of technical regulation. For this purpose a commission of the Eurasian Customs Union was set up. The commission assumes the coordination and supervisory function for all member states. The commission determined a total of 47 different sets of rules and some have already been introduced, including:

In the technical regulations of the Eurasian Customs Union, the Commission stipulates which products are subject to the mandatory EAC marking and the conformity assessment procedure in the form of the EAC certification or in the form of the EAC declaration. The certificates of conformity issued on compliance with the requirements of the technical regulations are valid for the entire area of ​​the Eurasian Economic Union . For the transition period up to 2015, some of the certificates and proof of conformity issued according to the old standards and regulations still apply.

The conformity test according to TR ZU of products, machines and systems is carried out in the form of a declaration or certification. In both cases, the applicant is required to provide the documents that serve to demonstrate compliance with the minimum requirements for safety standards and regulations (e.g. construction documents, safety considerations, instructions for use). After a successful conformity check, the certification takes place. An EAC certificate or an EAC declaration, like a GOST-R certificate, must be presented when importing the corresponding products at the border of the customs union.

Requirements and special features of the EAC marking

  • The application may only be submitted by a company based in the territory of the Customs Union (manufacturer himself or the legal person authorized by him). In this case, a simple authorization is not sufficient. A contract must be concluded between the manufacturer and the authorized representative to assume responsibility for the quality of the products and fulfillment of warranty claims by the authorized representative.
  • For the certification of serial production, in addition to the conformity test, a factory inspection is required to ensure quality control , as well as the annual inspections for the entire duration of the certificate's validity. The manufacturer or his authorized company can assume responsibility for the declaration to ensure quality control.

Implementation of the EAC marking

Only products, systems and machines that are first brought into circulation on the territory of the single customs union are subject to the conformity test. Machines that are intended for export and that have already been used are not subject to a conformity test. Proof of the residual utility value is required for the export of the used systems and machines.

The certification process is very similar to the Gossudarstwenny Standart Gost-R certification process. The technical regulations also describe which products are subject to certification and which are subject to an EAC declaration. Exporters must carry out this type of TR certification for the products that are subject to the declaration before delivery.

validity

The TR certificates can be issued based on a contract or with a validity of one to five years. The declaration can be issued both contract-related and type-related, subject to conditions for up to five years.
