The Tribunal Constitucional de Portugal ( German  Constitutional Court of Portugal ) is the highest court in Portugal . Founded in 1982 by the Conselho da Revolução after the Carnation Revolution , it resides in the Palácio Ratton on Rua de O Século, in the Mercês district . Its task is to judge new laws according to their constitutionality, to preserve and protect the existing constitution, to set the dates for elections and referendums and to allow or prohibit parties.

The judge

The Supreme Court of Portugal is the highest instance of the Portuguese judiciary, with other special Supreme Courts for military, administrative and tax issues. The Constitutional Court of Portugal has 13 members and oversees the constitutional interpretation of other national law. Ten judges are elected by the parliament, the Assembleia da República , each with a two-thirds majority of the MPs. The other three judges are elected by the judges already elected.

Of the 13 judges that make up the Constitutional Court, at least six must have previously been judges in a court in Portugal. The other seven constitutional judges must have at least a law degree. The judges' term of office is nine years; re-election is not permitted. The judges elect the President of the Constitutional Court from among their ranks and have their own budget. Joaquim de Sousa Ribeiro has been the current President of the Constitutional Court since October 2012 .

tasks

The tasks of the Constitutional Court are - in addition to assessing and assessing laws on their constitutionality - to organize elections and referendums, to approve parties or withdraw their approval, and in cases of doubt to confirm the unquestionable death of the president or his inability to carry out his duties.
