United Nations Dispute Tribunal

The United Nations Dispute Tribunal (Tribunal du contentieux administratif des Nations Unies) is the first instance service court of the United Nations .

The basis of the court is the resolution of the General Assembly 62/228 of December 22, 2007. Thereafter, as a successor to the previously existing United Nations Administrative Court, a two-tier jurisdiction was established on January 1, 2009, consisting of the United Nations Dispute Tribunal and the United Nations Appeals Tribunal .

The United Nations Dispute Tribunal is part of the United Nations Organization's internal legal system, which consists of informal and formal dispute resolution mechanisms. The informal mechanism consists of the ombudsman's office and the mediation office. The formal one from the Management Evaluation Board, the Dispute Tribunal and the Appeals Tribunal. There is also an ethics office that has competencies in the area of ​​restraining bullying within the UN Secretariat, but its efficiency is heavily questioned.

Composition and seat

The court will initially consist of three full-time judges based in New York , Geneva and Nairobi and two part-time judges. The judges are elected by the General Assembly on the recommendation of the United Nations Internal Justice Council .

The judges are elected for seven years and cannot be re-elected, with the exception of two judges determined by lot who are initially in office for three years and can then apply for a single additional seven-year term.

There is an appeal to the United Nations Appeals Tribunal against decisions of the United Nations Dispute Tribunal. In March 2012, Judge Mark Painter resigned prematurely as a judge of the Appeals Tribunals, because he no longer wanted to be "part of this farce" by his own admission . The court had deviated from its original mission to resolve internal organizational problems.
