Copyright (Luxembourg)

The copyright of Luxembourg grants the originator of a spiritual work , a subjective right about this that the ownership is near. In abstract terms, the work can be seen as detached from its material basis or embodiment. That is, being the owner of a painting or a floppy disk does not of itself confer ownership of the intellectual content embodied in it.

The copyright in the literary and artistic field ( propriété littéraire et artistique ) are a sub-category in the area of " intellectual property " ( Intellectual Property is), to which both the industrial rights ( propriété industrielle ) include the trademark ( of the brands ), the design ( dessins ), the models ( modèles ) and the patents ( brevets ).

Broadly speaking, industrial rights protect financial investments in particular, while copyrights, as such, protect the portion of the personality that the author has invested in his work. In contrast to industrial rights, copyright law does not require any special form. The author justifies his right simply by the fact that he created his work.

The core of Luxembourg copyright law is defined by the law of April 18, 2001 on copyright, related rights and databases, which was amended by the law of April 18, 2004.

Luxorr asbl is a non- profit association authorized by the Minister for Economic Affairs to act as a body for the collective administration of copyright.
