The Ordinance on Ship Personnel on the Rhine (Schiffspersonalverordnung-Rhein, RheinSchPersV) is issued by the Central Commission for Navigation on the Rhine . It regulates the manning regulations for ships sailing the Rhine on an international basis.

Local validity

The RheinSchPersV does not expressly determine local applicability. The Rhine is mentioned in the legal text. However, since legal provisions for Lake Constance and the Upper Rhine are regulated by the International Shipping Commission for Lake Constance, it can be assumed that the RheinSchPersV applies to shipping on the Rhine from Basel (Middle Rhine Bridge, km 166.64) down the Rhine to the mouth.

Occupation Regulations

The manning regulations of the RheinSchPersV apply

  • for ships from 20 m length or 100 m 3 volume (also for sport boats!)
  • Regardless of the ship's dimensions for tugs and push boats, passenger ships, floating equipment and ships with a certificate of approval according to ADN
  • not for ferries.

Depending on the type and length of the ship, the type of operation (daily journey time) and the equipment standard (roughly: with or without bow thruster), it is stipulated how many people with what qualifications must at least belong to the ship's crew. It is also specified how qualifications are to be demonstrated and which rest periods are to be observed. For passenger ships and ships that carry dangerous goods, there are corresponding regulations for additional security personnel.

Important for pleasure boating: pleasure craft less than 20 m in length may be driven by one person alone. From a length of 20 m, an additional person who is able to help with the ship maneuvers must be on board (§ 3.22).

Patents

The RheinSchPersV knows five patents:

  1. the great patent for driving all vehicles;
  2. the small patent for driving a vehicle less than 35 m in length, if it is not a tugboat or push boat or if it does not move any coupled vehicles, or for driving a vehicle that is intended to carry no more than 12 passengers ;
  3. the sports patent for driving a sports vehicle less than 25 m in length;
  4. the authority patent for driving authority vehicles and fire boats;
  5. the radar patent for radar travel.

For pleasure craft less than 15 m in length, a certificate of competency that complies with the national regulations of the states on the banks of the Rhine and Belgium for inland waters is sufficient, i.e. in Germany the pleasure craft license inland .

All patents (except for the radar patent, which is valid for the whole of the Rhine) can be issued for the whole of the Rhine or for individual routes for which route knowledge is required; In any case, they also apply to all routes that do not have to be tracked.

The RheinSchPersV regulates the prerequisites for acquiring patents, the examination content and procedures, the recognition of equivalent ship master's certificates as well as the period of validity and the withdrawal of patents.
