Enforcement on Sundays and public holidays

The enforcement on Sundays and public holidays is a peculiarity of enforcement . On Sundays and public holidays , bailiffs and law enforcement officers may not take enforcement measures unless a judge has given prior permission.

In order to obtain judicial permission , the obligee has to apply to the competent enforcement court before enforcement. If after submission of the judicial permission a foreclosure is carried out on a Sunday or public holiday, the judicial permission must be shown to the enforcement debtor.

In the context of administrative enforcement , permission is granted by the enforcement authority § 289 AO

The application as well as the permit are regularly submitted in form and also granted.
