The Provision Register Ordinance is the implementation regulation for Section 78a of the Federal Notaries ' Ordinance , according to which a central provision register for precautionary powers has been set up at the Federal Chamber of Notaries . The purpose is to make it easier to find power of attorney in the event that the principal is in need of care in order to ensure subsidiarity in accordance with To be able to ensure § 1896 Abs. 2 BGB .

Since March 1, 2005, the ordinance has also allowed the registration of power of attorney that has not been certified by a notary and contains regulations on the scope of data collection, the fees (which were specified in detail by the pension register fee statutes - VRegGebS - of the Federal Chamber of Notaries), the information to the guardianship court in the event of a guardianship proceeding , notification to authorized representatives, securing of the data and storage of the documents.

Notaries (and other notarial persons ) should refer to the registration option when notarizing a power of attorney ( Section 20a of the Notarization Act ). At the end of 2015, more than 3 million power of attorney was registered in the pension register.
