A weapon ban zone ( abbreviated to WVZ in Germany ) is an area in which the carrying of weapons is prohibited by official ordinance ( weapons ban ). The gun ban zone can be limited in time and gives the police or the security authorities the opportunity to carry out identity checks at criminal areas without suspicion . In addition, a zone under police law is often set up, which prohibits the carrying of so-called dangerous objects.

In Germany, the enactment of weapon prohibition zones is regulated in Section 42 (5) of the Weapons Act. The state governments are responsible for issuing the ordinance. Carrying guns on public roads, paths and squares can be prohibited if criminal offenses involving the use of weapons or robbery, bodily harm, threats, coercion, sexual offenses, deprivation of liberty or crimes against life have been committed repeatedly in these locations and facts justify the assumption that such crimes can also be expected in the future.

With the entry into force of the 3rd Weapons Rights Amendment Act (3rd WaffRÄndG), public and particularly frequented places can in future be declared VMS without having to be considered criminal beforehand. The authorities can issue a more stringent knife ban: knives with a fixed or lockable blade that is over four centimeters long may no longer be worn.

Police law

According to the police law of the federal states, zones can be set up by ordinance in which the carrying of so-called dangerous objects is prohibited.

Places with no weapons zones

Gun prohibition zones existed or still exist in Germany, for example in the cities of Berlin, Hamburg, Leipzig or Saarbrücken, all of which are in different countries.

Austria

In Austria , the regulation of weapon prohibition zones is regulated in Section 36b of the Security Police Act (SPG), the competent authority is the locally competent security authority of the first instance. It is forbidden to enter a weapon ban zone with weapons (according to § 1 WaffG 1996 ) or objects that are suitable and, according to the circumstances, serve to exercise violence against people or property . The organs of the public security service are authorized to search people or their clothing, vehicles etc. if there is a suspicion that they are violating the prohibition. In this case, the organs of the public security service are authorized to seize the weapon or the object. The authority can impose an administrative penalty of up to 500 euros on the persons in accordance with Section 84 SPG, and in the event of repetition up to 2,300 euros. Gun prohibition zones can only be used for a period of up to three months and only for public places in which, due to certain facts, in particular due to previous dangerous attacks, it is [...] to be feared that dangerous attacks against life, health or property will occur will come from people, will be ordained.

Gun ban zones existed or existed in the cities of Vienna , Linz and Innsbruck .
