The law regulating housing brokerage (Housing Brokerage Act) is a German law that regulates the activity of brokers in the area of ​​brokering (rental) contracts for living space . In particular, it includes regulations on the action of a broker, on the permissibility and amount of the commission (maximum of two monthly rents plus statutory sales tax) as well as formal requirements for apartment offers. Violations of individual regulations constitute an administrative offense that can be punished with a fine.

Since June 1, 2015, the ordering principle has been in effect , according to which the agent pays the brokerage commission.

The law was enacted in 1971 as Art. 9 of the law to improve tenancy law and to limit rent increases and to regulate engineering and architectural services (Federal Law Gazette 1971 I p. 1745, 1747).
