a heads-up on the List of Guantanamo Bay detainees

Greetings,

Since you voted to keep the article List of Guantanamo Bay detainees I thought I would give you a "heads-up". A copyright violation was filed against the article, on October 11th. It was filed by someone who had voted to delete the article on October 5th.

I believe that the copyright violation is entirely bogus. I believe it is bogus because, as explained in Feist Publications v. Rural Telephone Service, lists of facts, like lists of names, cannot be copyright. This Feist v. Rural case went all the way to the US Supreme Court, which made the possibly counter-intuitive ruling that the amount of effort someone put in to compiling a list plays no role in determining whether that list is eligible for copyright protection.

Even if alphabetic lists of names could be copyright, I believe the wikipedia list would not be violating copyright since the list was compiled from various sources.

Yes, I have considered that this user invoked a bogus copyright violation to achieve a result that failed in the {AfD}. Yes, I asked them to terminate the copyright violation process, in light of Feist v Rural. They declined. The backlog in the administrators dealing with copyright violations seems to be on the order of a month long.

Anyhow, I wanted the people who had shown interest in the article to not freak out, or feel betrayed, by seeing the copyright violation tag. -- Geo Swan 11:36, 19 October 2005 (UTC)[reply]

Six Run Creek

I was random page hopping and landed on Six Run Creek. Could you take a look at the first sentence and clarify its meaning? "Six Run Creek is a tributary of the Black River, approximately 50 miles (80 km), in south-eastern North Carolina in the United States." I think there's a word missing after "50 miles (80 km)". Thanks for your interest in the image, and in the issue of copyright. The image belongs to me, as I created from public domain sources. Hence the copyright in my name, which links to my user page. I have uploaded and contributed many of my own created images, as well as to the Commons, many based on public domain sources. The image in question is not located anywhere else on the Internet. I have had no problem with any other up until this point which this practice. If there has been a shift in copyright verification policy, then please elaborate exactly what the new policy is, and how it differs from the old one that I have practiced. Of course, you're welcome to take the issue to the appropriate place in Wikipedia for arbitration. I don't participate actively much in Wikipedia anymore, only occassionally, so I probably am not going to wage a big campaign to defend the image, if it comes to that. Well since you finally asked the correct question (although not very politely), I'll tell you that don't rememember where it came from, other than a public domain NASA source, as indicated by the file title. I agree a link there would be good and proper, but I have since moved several times and it would probably take a lot of research to track it down, given my life circumstances right now. The policy to which you referrred was either not in effect or was not enforced at the time of my uploads, so in a sense you are applying this rule ex post facto, which is OK (and often necessary) but smacks of immaturity on your part. What I told you about the source is all I can tell you off the top of my head, and all that I will tell you for the time being. Personally I find it amusing that you are choosing to spend all this energy as a relative newcomer to attack my contributions and making these blustery demands of me, given how little content you've actually contributed (side note of advice: experienced users can see right through the "Hey, I'll pump up my contribution count by nominating and voting on things for deletion and earn the attention and respect of the community" strategy). I furthermore find it odd that you haven't nominated any of my many other images for deletion, including the ones based on this same underlying public domain image. There are several hundred for which I probably can't supply the source at this point without a bunch of work which is not my priority now. I can probably do so over time, but certainly not in the next week. You're welcome to add "based on a public domain source courtesy of NASA" to the image pages if you'd like (if you're in a mood to be truly helpful as an editor). Otherwise I sincerely suggest you nominate *all* my images as possibly unfree. I had been planning to move them to Commons longterm anyway (Just for fun, you should try this same kind of demanding deletionist behavior over there and see what happens...). In the meantime you can pat yourself on the back for freeing Wikipedia from the scourge of my uploads. I simply don't understand what would have been so hard about dropping me a polite inquiry note on my user talk page about this without going halfcocked on a deletionist crusade (isn't this the second ever image ever you have nominated?). You have (in my opinion) a lot to learn about Wikipedia and how things work here. I have asked where the image came from multiple times, I'm not sure how you missed that statement.

Why have I not tagged all your other images for deletion? Because I'm not going to stalk you, and I find it odd that you would suggest this option. I simply ran across the image on the Wind Rivers article, and tagged it as missing a source. Again, I'm not on any type of deletionist crusade, I simply responded to a lack of information. If you had responded with the truth the first time, ie "I don't remember the exact source except for it probably was a public domain Nasa image." instead of "I own the copyright" this whole mess could have been avoided. Furthermore your threat at sabotoging any future attempts I might have at "administrator" status (which have long ago been stamped out) smacks of an immature temper tantrum.

But I did not give you permission to change the copyright to public domain for the image. Alterations on a public domain image belong to the alterer, by copyright law, and you have no legal right to remove that (the public domain is not the GFDL: it doesn't "carry over" to alterations). This may seem trivial for such a small alteration in this but most of my work involves much greater alterations (Missoula Floods and Virgin River for example). I would very much appreciate it if you consult me before underlying removing copyright on my own creative works. If someone wants to download the Wind River image, cut out my alterations, and use the public domain part, that is their right of course, but from my understanding, even NASA does not have a right to use the original alterations without my permission. Asking permission to photography Amish people is polite, it is respectful, it is not a legal requirement. I suspect the concern here centers on the Amish belief that being photographed may make them tempted by pride. Amish people are often photographed without permission, and not as traumitized as members of some Oceania and Amazon peoples that believe to photograph them is to take away some of their life force, or even their souls. That is a far more traumatic situation, and there is quite a lot written about this. CApitol3

Peer Review request

List of Pennsylvania state parks (which you started) is currently in peer review at Wikipedia:Peer review/List of Pennsylvania state parks. The list has expanded a bit since you started it, and is now a complete list of all current 120 state parks in Pennsylvania, with shorter lists of all known major name changes for these parks, as well as all known former parks. An anonymous IP edited it six months later to change the name to Frank Perez. Can you clarify the status of this image? I'm going to list it on WP:PUI in the meantime, since you don't seem to be around, but if you can clarify how this image was made that would be best. Thanks. Length of the Willimantic River.

Some time ago, you added information that the Willimantic River is about 35 miles long; this page says it runs for 25. Do you remember what your source was on that information? I've set it to 25 for now, since I can source that. Well also make preparations for our exciting Wikipedia Takes Manhattan event, a free content photography contest for Columbia University students planned for Friday March 28 (about 2 weeks after our meeting).

In the evening, we'll share dinner and chat at a local restaurant, and (weather permitting) hold a late-night astronomy event at Columbia's telescopes.
