The term Allnet Flat is made up of the English words for "all networks" and the abbreviation for " Flatrate ". The combination “Allnet Flat” is not used in the English-speaking world, but was probably created in Germany from 2008 onwards.

The first all-network flat rates in Germany - even if the term was not yet coined - were presented at CeBIT 2007. At that time they cost 89 or 90 euros per month. The providers were freenet AG and BASE . Cell phone tariffs with a cost airbag can also be seen as a forerunner of the Allnet Flat rate, as they included unlimited phone calls at an affordable price thanks to a cost brake.

In 2009 the Superflat Internet Allnet was introduced at Vodafone and the Young Flat Allnet from MoBlack. In addition, the term SMS Allnet Flat - a flat rate for any number of SMS in all domestic networks - was coined at that time.

The term “Allnet Flat” for a mobile phone flat rate in all networks will be used as a tariff name at the beginning of 2010 for the first time by BASE as part of the introduction of the BASE tariff flower. 1 & 1 named an Allnet Flat tariff for the first time in July 2010, which made the term widely known through massive TV advertising. The background was the first MVNO contract, which 1 & 1 had concluded with the network operator Vodafone in March 2010 and which, according to a press release, enabled considerably more favorable conditions accelerated for cell phone charges.

In 2007 you paid 90 euros per month for an Allnet Flat rate with SMS Flat rate and data volume, today you can get an Allnet and SMS Flat rate including data volume for less than 7 euros per month. Allnet flat rates with large monthly data packages and LTE from network operators are still significantly more expensive. In the meantime there are also LTE Allnet Flats at discounters, especially in the O2 network, however, LTE Allnet Flats often do not have tariffs with fair flat rates , but with "data automatic" (Drillisch, Vodafone). Internet access is not throttled when the monthly data volume is exceeded, but additional data volume is automatically booked for a surcharge. In the meantime, however, this automatic system can also be switched off again at most providers, and some discounters such as Smartmobil have removed it completely. At the beginning of October 2016, o2 replaced the previous “all-in” tariff series with “o2 free”, in the course of which the automatic data system was replaced by a fair flat rate with an unusually high maximum speed of 1 Mbit / s after the high-speed volume was used up. The automatic data control was also removed. In the latest 02 tariff generation (from 2020) there is no longer this restriction.

Legal dispute regarding the use of the term

ALLNET GmbH, a manufacturer and wholesaler of network technology and telecommunications equipment, had sued against the use of the term Allnet Flat . She saw her naming rights violated and wanted to enforce a ban on the use of the term "Allnet Flat" for cell phone flat rates in all networks.

In the first instance, the Frankfurt Regional Court followed Allnet GmbH's argument and issued a ban on the use of the term “Allnet Flat”. The law firm Siebeke Lange Wilbert then appealed against the judgment to the Frankfurt Higher Regional Court.

As a result, the OLG decided on July 10, 2014 that the name of one of the most important products in the mobile communications industry, the “Allnet Flat”, does not infringe the company name “ALLNET”. The Frankfurt Higher Regional Court thus overturned the judgment of the Frankfurt Regional Court.

The main reason for the decision was the mass use of the term Allnet Flat by almost all providers and the press. The decision is not yet final, but the Frankfurt Higher Regional Court has not allowed an appeal.
