An application procedure is only carried out by an authority or a court upon request . Similar to a lawsuit , a personal concern should usually be taken into account. This distinguishes it from an ex officio procedure , which is often also in the public interest.

Examples

Application for recognition as a conscientious objector

The application must be submitted in writing or to be recorded at the responsible district military replacement office . An informal application , referring to Article 4 Paragraph 3 of the Basic Law ("I hereby apply for recognition as a conscientious objector in accordance with Article 4, Paragraph 3 of the Basic Law.") Is sufficient to initiate the recognition procedure.

A detailed explanation of the reasons for the decision of conscience and a complete curriculum vitae must be attached to the application. If these documents are not submitted together with the application when the application is submitted to the District Armed Forces Replacement Office, the Federal Office will request these documents in the recognition procedure.

After the District Armed Forces Replacement Office has confirmed receipt of the application and eligibility for military service has been determined in the draft procedure, it forwards the application together with the personnel documents to the Federal Office for Family and Civil Society Tasks for further processing.

The applicant will be recognized if the application is complete and suitable to justify the right to recognition. If the Federal Office has doubts about the truth of the information, a written or, if necessary, oral hearing will be held in which the doubts can be cleared up again.

If the application is rejected, an objection to the rejection is possible. If the objection is rejected, an action can be submitted to the competent administrative court.

Land register entry

An entry in the land register is generally only made upon application ( Section 13 Land Register Regulations ).
