Live and act

Gaudenzi was a legal historian and full professor of Italian legal history at the University of Bologna , where he studied and graduated in 1880. His thesis Sui collegi degli artigiani in Roma , which he passed with distinction, was published in the Archivio giuridico XXXII in 1884 .

At first he devoted himself in his studies to the history of the diritto intermedio , d. H. the history of the legal systems in force in Italy from the end of the Roman Empire to the establishment of the nation state, as well as legal positivism . Finally, he turned to research in Germanic law, as a result of which he published two works, La misura delle composizioni nelle antiche leggi germaniche (Bologna 1883) and La legge salica e gli altri diritti germanici (Bologna 1884). In the following years he approached the writings and thoughts of Nino Tamassia by moving away from the Germanic concept of the diritto intermedio that was prevalent in Italian historiography and turning to the idea of the continuity of Roman law .

He traveled through various cities to deepen his knowledge and discovered valuable legal manuscripts from the High Middle Ages, which he edited, such as Un'antica compilazione di diritto romano e visigoto con alcuni framenti delle leggi di Eurico tratta da un manoscritto della biblioteca di Holkham (Bologna 1886), a collection later named Collezione Gaudenziana by scholars . Gaudenzi published six chapters of the Codex Euricianus from a manuscript in the Biblioteca Vallicelliana in 1888 under the title Tre nuovi frammenti dell'editto di Eurico in the Rivista italiana per le scienze giuridiche .

Based on his discoveries and studies, Gaudenti started an ambitious project with which he planned to publish previously unpublished legal texts in three sections ( glossaries , ancient canonical collections and Roman legal testimonies from the High Middle Ages ). Only the first part of this project came about, but in the same years the study of glossaries led him to the city studies of Bologna. After his membership, he became professor emeritus at the Regia Deputazione di storia patria per provincie di Romagna, a number of local state institutes on the history of Italy before unification.

He died in Modena on March 25, 1916.
