In the Federal Republic of Germany, the building contractor in road construction is the authority responsible for the planning , construction, operation and maintenance of a road intended for public transport. As a rule, this is the public sector (state, state, municipality). In contrast, there are private roads for public transport, where the building contractor is a non-public facility. Their number is very small, but has increased sharply in recent years.

Classification

Construction authorities for federal highways , which are federal roads (abbr .: B nn) and motorways (abbr .: BAB  nn), is the federal government, ie the Federal Republic of Germany. For the road category Landesstraße (abbr .: L  nn) or state road (abbr .: St  nn), the responsible federal state is the building contractor ; for the district road (abbr .: K  nn) the relevant district and for the community / city road within the locality the relevant community / town. The legal basis for this is Section 5 of the Federal Trunk Road Act .

In the case of supra - local roads in localities , so-called local thoroughfares , the municipality is the building contractor if it exceeds a specified number of inhabitants, otherwise the respective supra - local road building contractor. The necessary number of inhabitants to change the road construction load are regulated in the respective road laws of the federal states. Depending on the federal state, they are between 20,000 and 80,000 inhabitants.
