Ship management
Under ship management refers to the technical and commercial management of ships . The owner of the ship ( shipowner ) can transfer the management to a service provider. In this case, the contracted service provider is called the contract shipping company or ship manager.
The assigned tasks as well as duties, remuneration, questions of liability and other essential points are regulated in the ship management contract. Model contracts can serve as a basis, as they are e.g. B. published by BIMCO .
Duties of the contract shipping company
The typical tasks of the contract shipping company include:
- the care that the ship is properly manned, seaworthy and loadable
- Manning
- Purchase of bunkers (fuel), lubricating oils and spare parts
- Provisions and other ship supplies
- Preparation of docking , repairs and class work
- Conclusion of the usual insurance for the ship and settlement of claims
- Control and implementation of operational use
- Charter the ship to other companies
- Affreightment of the ship
- Settlement of travel orders or creation of charter invoices
- Establishing the expected ship operating costs (annual budget)
- Reporting for the owner (condition of the ship, target / actual comparison calculations, billing of docking costs, etc.)
- Elimination of malfunctions, billing of off-hire times
Relationship between contract shipping company and owner
The contracted shipping company carries out all activities in the name and for the account of the owner. Therefore, the contract shipping company does not usually bear any risk with regard to the level of the ship's operating costs. Furthermore, the owner generally keeps him free from all third-party claims arising from his activity, provided that the contract shipping company has acted within his area of responsibility and with the necessary care.
He receives the contractually agreed remuneration for his work (usually as a percentage of the ship's income or in US dollars per day). Whether the agreed remuneration covers his costs is his business risk. The liability of the contract shipping company is usually contractually limited to 10 times the annual shipping fee.
