The professional association of data protection officers in Germany (BvD) e. V. is an association based in Berlin that represents the interests of corporate and official data protection officers in Germany.

goals and tasks

The main focus of his work is the further establishment of the professional profile of the data protection officer in politics, business and society as well as the support of the members in their work as data protection officers and consultants. The quality assurance of services offered by members of the professional association has the highest priority as a unique selling point in the competition. The BvD promotes the exchange of experiences between its members and supports them with professional advice. He advocates data protection issues in public and participates in legislative projects in the area of data protection law .

structure

The highest body of the association is the general assembly. It decides on the points assigned to it by the statutes.

If the general assembly is not responsible, the board decides. The board consists of the chairman, his deputy, a legal advisor and currently three other board members.

The Board of Directors has set up a committee for each of the core tasks of job description and advanced training. The committees are made up of members.

The members come from all federal states. They are often organized and networked in one of the regional groups in order to promote the continuous exchange of experiences.

history

The association was founded in 1989 in Ulm . Even in the founding phase, the professional association “struggled” with considerable headwinds: The association was initially refused entry in the register of associations on the grounds that the association was small and did not have the character of an association. After the establishment of several regional associations, the registration failed because the data protection officer was denied the quality of a profession. The association then brought an action at the Ulm Regional Court . In 1991, the Ulm Regional Court decided in what is known throughout Germany as the “ Ulm Judgment ” on the principles that make up the profession of data protection officer.

The first chairman was Gerhard Kongehl until 2004 . In 2015 he received the Federal Cross of Merit in Ulm , because with his work he "performed outstanding services for data protection in Germany and also made the special importance of data protection for a free society for a whole professional group the basis". His successor Hannes Fedderath was chairman until 2008. Since then, Thomas Spaeing has chaired the association.

In 2007 the association moved its headquarters from Ulm to Berlin in order to be closer to political events and to be able to better influence politics.

In December 2012 the association had around 800 members.

Every year the BvD receives around 100 placement inquiries from companies looking for a data protection officer.

The BvD held data protection congresses until 2009:

  • 2009: Experience meets future 9./10. September 2009 in Ulm.
  • 2008: Data protection - opportunities - benefits 10./11. April 2008 in Berlin

Association days have been held in Berlin since 2010. The association days are each dedicated to a key topic, which is dealt with on the second day in various lectures and workshops. On the first day, the working groups have the opportunity to meet during the day. The annual general meeting takes place in the afternoon. In the evening some members and the participants, speakers and exhibitors of the association days meet for a communal dinner.

The past association days have so far been dedicated to the following main topics:

  • 2012: "New ways in data protection", 09./10. May 2012 (the day before meeting of the AK Medicine and AK Law , BvD special seminar “Compliance & Employee Data Protection - (Anti-Corruption Vers. Data Protection)”, day of action of the “Data protection goes to school” initiative at the John Lennon High School in Berlin, after the BvD Association Days subsequent meeting of the external working group )
  • 2011: "Challenge of the data protection officer", 25./26. May 2011 (the day before meeting of AK Medicine and RG Ost , after the BvD Association Days afterwards meeting of AK External )
  • 2010: "In exchange with professional colleagues", April 23, 2010 (only one day, followed by a meeting of the external group )

Since 2010, the BvD has also been organizing the annual professional profile symposium. The BvD invites representatives of the supervisory authorities of the federal and state levels, trainers, data protection associations, etc. to Düsseldorf.

The previous career profile symposia have so far been devoted to the following questions:

  • October 25, 2012: 3rd professional profile symposium in Düsseldorf in the Rheinturm
    • Presentation of the training regulations developed by the BvD and discussion about them
    • "Can the data protection officer call in external expertise?"
    • Cooperation between works council and data protection officer
  • October 7, 2011: 2nd professional profile symposium in Düsseldorf in the Rheinturm
    • "Are minimum order times for data protection officers mandatory and if so, how long do they have to be?"
    • "How long is the right time required to work as a DPO? (Definition of the time required, including mandatory attendance question) "
    • "Can the client's data protection officer also be the contractor's data protection officer?"
  • October 8, 2010: 1st professional profile symposium in Düsseldorf in the Rheinturm
    • "Is there a small amount of specialist knowledge in jobs in smaller companies?"
    • "How much specialist knowledge does the data protection officer need himself, how much can he buy?"
    • "Which conflicts of interest of a data protection officer do you have to accept and can legal entities be appointed as data protection officers?"

Since 2016, the BvD has been continuing the data protection wiki of the Federal Commissioner for Data Protection and Freedom of Information (BfDI) in cooperation with the Ruhr University Bochum.
