Legal dispute over the brand "Egger Bier"
When the Fritz Egger private brewery , based in Unterradlberg, expanded its beer sales to the state of Vorarlberg in the late autumn of 1978 , there was confusion between the products of both manufacturers among retailers and consumers, as both the Egg brewery and the Fritz Egger private brewery sold their beers as "Egger Beer "or" Egger beer "offered. The Egg brewery then submitted to the court the main request to “prohibit the Fritz Egger private brewery from using the name Egger beer in commercial transactions without a distinctive addition, and the contingent request to prohibit the defendant from using this name without a distinctive addition in the state of Vorarlberg "; the name Egger Bier has "long since achieved traffic recognition in the relevant public".
The Supreme Court finally granted on March 30, 1982 - like the lower courts - only the contingency request of the Egg brewery; the main request was rejected on the grounds that "Egger beer" was distributed in all districts of Vorarlberg, but the distribution area of this beer had never crossed the border of the federal state of Vorarlberg.
