The Federal Police Record Evidence (BAN) is one of the five permanently installed files of the German Federal Police in accordance with Section 36 of the Federal Police Act (BPolG). The file was created on August 26, 2004 and contains 55,584 records (as of November 19, 2007).

The purpose of the file is to provide evidence of personal files , their keeping at federal police stations and the authorities charged with carrying out police control of cross-border traffic in order to fulfill the duties incumbent on them in the area of ​​criminal prosecution and security.

In addition to the authorities of the Federal Police, the offices of the federal states of Bavaria , Bremen and Hamburg , which are entrusted with the police control of cross-border traffic, supply data for the BAN file by means of data transmission on their own responsibility. These bodies are also authorized to access data; This right is also available to those customs offices that perform tasks in accordance with Section 68 BPolG.

The legal basis are Sections 1 to 7, 12 and 29 BPolG and Sections 483 (3) and 484 (4) StPO .

The stored data is regularly deleted: in the case of criminal offenses and after the Federal Police have been investigated, after 5 years and in all other cases (particularly in the case of requests for searches from other public bodies) after 2 years.
